Has China won?

“Het is verstandiger te zorgen voor het welzijn van de bevolking dan het uitgeven van miljarden voor oorlog.”

Has China Won? door Kishore Mahbubani is een van de vele boeken over de rol van China binnen de nieuwe wereldverhoudingen en de gespannen met de Verenigde Staten. De schrijver is een Singaporese strategische denker en was tien jaar de VN-ambassadeur voor de stadstaat. Zijn gedachten zijn niet minder interessant, omdat hij uitgebreid lunchte met Kissinger en CEO's van grote bedrijven sprak. In verschillende ideologische bellen kunnen dezelfde gedachten leven. De schrijver is een vurig aanhanger van de geglobaliseerde markteconomie; maar ook een groot deel van de marktventers heeft geen belang bij conflicten.





Mahbubani is een pleitbezorger voor een autoritaire verzorgingsstaat. Het komt er binnen zijn visie op neer dat er een balans moet worden gevonden tussen economische groei (om burgers welvaart te geven en onrust af te kopen), stabiliteit en persoonlijke vrijheid. Die aspecten zijn ook van belang binnen de politiek van de twee grootmachten. Wel krijgen ze binnen die afweging een verschillend gewicht. Zijn pijlen richt hij echter vooral op “het falende politieke en sociaal economische systeem” van de Verenigde Staten.

Vragen

Het boek begint met vragen over een tiental onderwerpen. Zonder de juiste vragen, geen juiste antwoorden, zo stelt de auteur. Hij vraagt zich af welke strategische implicaties het voor Washington zal hebben als de Chinese economie groter wordt dan die van de Verenigde Staten? Wat moet prioriteit hebben binnen de VS, het welzijn van de bevolking of een prominente internationale positie? Vilein zijn de vragen of het in het belang is van China dat de Verenigde Staten de militaire begroting verhogen of verlagen en of de VS een tegenwicht voor China kan vormen als het zijn bondgenoten tegen zich in het harnas jaagt? Hoe behoudt de VS de krachtige positie van de dollar als internationale reserve munt en kan ze deze positie wél gebruiken voor unilaterale sancties? Verliest de Verenigde Staten zijn interne weerbaarheid niet door internationale verdragen aan de laars te lappen en bijvoorbeeld marteling te normaliseren? Zijn de strategische denkers in de VS wel in staat om de essentie van de strijd met China te vatten? Drijft de irrationele angst voor het gele gevaar de Amerikaanse politiek en kan dit wel voldoende aan de orde gesteld worden in de politiek correcte omgeving in Washington DC? Wie bereidt zich beter voor op de behoeften in een toekomstig conflict? Het valt op dat vrijwel alle vragen aan Washington geadresseerd worden. Het boek is blijkbaar gericht op de beleidsmakers in de VS (het land van de schoonfamilie van Muhbubani).

Chinese fout

Toch heeft het eerste hoofdstuk na de introductie de titel Wat is China's grootste fout? De schrijver constateert dat China zich heeft vervreemd van de internationale industrie, door deze te schofferen, onbetrouwbaar te zijn bij afspraken en mogelijkheden te beperken. De Chinezen hebben de Amerikaanse bedrijven uitgeperst en zo kon Donald Trump zonder een temperende invloed uit het bedrijfsleven zijn strijd tegen China beginnen.

Geen plan

Aan het begin van de Koude Oorlog zette Georg Kennan in Foreign Affairs (onder het pseudoniem Mr. X) de containment strategie uiteen. Een dergelijk uitgangspunt is er nu niet. Has China won? Is geschreven tijdens de Regering Trump, waar improvisatie en zakeninstinct de norm was. Hierbij werd zelfs de positie van de dollar als internationale wissel- en reservemunt ondergraven, stelt de schrijver. Dat gebeurt zelfs terwijl die dollar maakt dat Amerikanen op grotere voet kunnen leven, en het is daarom reden voor verbazing. Maar hebben de VS niet de luxe gaandeweg een politiek te ontwikkelen? Het is nog steeds verreweg het machtigste land binnen de (Westerse) wereld. Markten houden over het algemeen van voorspelbaarheid, maar pragmatisch sturen en bijsturen zijn al decennia een wezenlijk aspect van de Amerikaanse buitenlandse politiek. Bovendien de door Trump wild uitgeroepen boykot van Chinese technologie valt steeds meer op vruchtbare bodem. De VS krijgt – ook onder de Regering Biden – steeds meer landen en organisatie mee voor het weren van Chinese technologie met meer of minder strategische waarde. Het opzeggen van verdragen, zoals het het nucleaire akkoord met Iran, strijkt bondgenoten tegen de haren in, maar ook hier volgt de Europese Unie na verloop van tijd en gaat mee in een nieuwe longer and stronger aanpak die de VS nu voorstaat. Uiteindelijk trekt Washington nog steeds aan het langste eind in het binden van machtige bondgenoten. Mahbubani schildert een te zwakke Verenigde Staten.

Niet expansionistisch

Mahbubani lijkt anderzijds soms wel een advocaat voor de Chinese zaak. De auteur stelt niet als eerste dat China geen militaire expansionistische agenda voert. China zet politieke en economische diplomatie in. Zo moet ook het Belt and Road initiatief worden gezien. Dit is gericht op relaties met de buurlanden. Hij schildert het concept daarmee wel heel bescheiden af (het betreft het hele Euraziatische continent en delen van Afrika, zie kaart). Het uitbreiden van Chinese militaire middelen komt in het boek niet tot nauwelijks aan de orde, net zo min als troepenopbouw en grens schermutselingen met India. Het mag zo zijn dat de Chinese militaire uitgaven bescheiden zijn in vergelijking met de VS en zelfs geringer dan die van de Europese Unie, maar onbetekenend zijn ze niet. Door ze uit te wissen, mis je ook mogelijkheden om een politiek van ontspanning en diplomatie te bepleiten.

Wel gaat hij in op de Spratly eilanden in de Zuid-Chinese Zee en op Taiwan. Je kan moeilijk anders. In beide gevallen is het voor hem een aanleiding om de positie van China te verzachten. Rond de Spratly's beloofde China geen militaire infrastructuur te bouwen als de Amerikanen geen marineschepen zouden sturen om China te provoceren. Het was een aanbod waar de Verenigde Staten niet op in ging en in plaats daarvan marine patrouilles opvoerde met het argument dat het de vrijheid van navigatie diende te waarborgen. (Alsof handelsland China daar zelf ook geen belang bij zou hebben, zo stelt de auteur.) China reageerde toen pas met het aanleggen van militaire faciliteiten. Maar China verklaarde de zee wel al eerder tot een eigen binnenzee. De schrijver noemde dat al eerder een atypische emotionele Chinese aanpak, die niet in het belang is van de relaties met de buurlanden. Hiermee typeerde hij de kwestie als afwijking en nam de wind uit de Chinees annexatie zeilen.

Taiwan en binnenlandse conflicten

Taiwan is binnen de Chinese politiek wel degelijk een casus belli. Mahbubani voert een leger aan argumenten uit de 19e en 20e-eeuwse geschiedenis aan waarom Beijing aanspraak kan maken op het eiland. Het feit dat ook in Taiwan het vasteland van China en het eiland zelf als één China worden gezien (niet door elke politieke stroming overigens), laat zien dat de situatie niet simpelweg zo is dat Taiwan tegenover China staat. Daarnaast kalft de één China constructie die na 110 jaar op zijn zachtst gezegd af. Taiwan gaat steeds meer een eigen weg, dat opzij zetten is politiek realisme, waarin de machtigste staten aan de langste touwtjes trekken, maar doet geen recht aan de Taiwanese bevolking. Opmerkelijk bij een schrijver met oog voor geostrategische kwesties ontbreekt het argument dat het eiland tijdens een uit de hand gelopen militair conflict in handen van de VS een gevaarlijke uitvalsbasis voor de Amerikanen zou zijn. Maar dat is wel verklaarbaar. De rationele logica achter een militair conflict tussen de VS en China wordt door hem verworpen. Maar Tibet, Xinjiang en Taiwan zijn Chinees “dat zijn harde politieke gegevens die niet kunnen worden veranderd.” Het mag zo zijn dat de Verenigde Staten regelmatig kolen op het Taiwanese vuurtje gooien, maar ik mis hier de verschillende stemmen vanuit Taiwan (dat die vanuit Beijing geen ruimte krijgen is duidelijk, maar dat hoeft een onafhankelijk schrijver uit een klein Aziatisch land toch niet te weerhouden).

China heeft inderdaad honderdduizenden moslims in heropvoedingskampen gezet, beaamt de schrijver, maar de VS martelde duizenden moslims, gooide bommen en voerde een groeiend aantal gerichte moordaanslagen uit. Allemaal waar, maar vergoelijkt het een het ander? Dat Hong Kong met kracht ingelijfd wordt vergelijkt hij met de Indiase inlijving van Goa door India tegen de Britse wensen in. “De echte strijd gaat er niet om democratie, maar om de strijd tussen de werkende klasse en enkele vastgoed magnaten,” alsof het conflict niet veel ingewikkelder is geworden en groepen van de ene naar de andere kant zijn overgelopen en alsof studenten stromannen van tycoons zijn. Kritiek op de Chinese controle Staat miskent de wens van de Chinese burger naar stabiliteit, rust en orde. Ze kiezen daarom vrijwillig voor minder persoonlijke vrijheden.

Interventionistisch

De VS daarentegen heeft een geschiedenis van militair optreden. In de 190 jaar voor de Koude Oorlog 216 maal. In de kwarteeuw na de Koude Oorlog, zelfs 152 maal. De cijfers zijn door de schrijver ontleend aan een rapport van de onderzoeksafdeling van het Amerikaanse Congres (hier een link naar de laatste update). Ze intervenieert niet alleen militair, ze doet dat ook nog eens als er geen nationale belangen mee gemoeid zijn. De VS produceert zelf fossiele brandstoffen; voldoende om niet afhankelijk te zijn van het Midden-Oosten. Blijkbaar zag de Amerikaanse elite het anders. Voor hen waren de belangen in de regio essentieel genoeg om militairen te sturen sinds het einde van de Koude Oorlog in 1989 er ruimte toe bood. De Amerikaanse Midden-Oosten politiek heeft bovendien al bijna een eeuw een sterk ontwikkelde kant van politieke en militaire beïnvloeding, controle op de olie voorraden in de Arabische wereld, op de opgebouwde financiële rijkdommen. In de 21e eeuw stuitte men wel op de grenzen en ging er zelfs ver overheen in een poging eerder zelf gecreëerde problemen te beteugelen. Of de inzet van die militaire middelen verstandig is, is een andere kwestie dan of er belangen achter zaten (het is de vraag van wie, welke landen, welke (delen van) de elite). Voor Muhbubani komt het echter beter uit te doen of militaire interventies ervan gespeend zijn. Het is noodzakelijke koren op de molen die draait zonder een dreigende militaire strijd tussen de VS en China. De diplomatieke aanpak van China – het kopen van politieke en economische invloed – is immers goedkoper en lucratiever. In de Verenigde Staten zou men dit ook moeten zien. Echter in Washington zijn ambassade posities wisselgeld geworden voor hen die de gekozen president steunden, constateert Mahbubani in navolging van velen. Door de korte periode dat de VS de enige supermacht in de wereld leek te zijn verloor het bovendien de kunst van het maken van compromissen met de rest van de wereld. Het is een grote zwakte van Washington. Tijd dat men wakker wordt. De militaire molen draait in Washington echter nog steeds als een tierelier.

Chinese winst

Het is in China's voordeel als de Verenigde Staten doorgaan met het besteden van grote delen van de begroting aan het in stand houden en uitbreiden van militaire capaciteiten, zo analyseert hij. Het is immers een irrationaal proces waarin de Verenigde Staten gevangen lijkt te zitten. Ondanks de enorme industrie van denktanks is de VS na de Koude Oorlog niet in staat geweest de militaire bestedingen naar beneden te brengen. Gevestigde belangen spelen hier een grote rol waarin juist die denktanks en militaire industrie samenwerken bij het aandikken van de gevaren voor het voetlicht te brengen dan zij die deze overdrijvingen willen ontmaskeren. (William Arkin schreef hier in The Generals have no cloths over.) Het is een analyse die tevens impliceert een minder militaire koers te varen.

Hypocrisie argument

Voor een politiek denker afkomstig uit de elite van het autoritaire Singapore, met grote invloed van de bevolking met Chinese achtergrond, hoeft het niet te verbazen dat Mahbubani stelt dat het politieke systeem van China staat als een huis en is geënt op ruim 2.000 jaar geschiedenis en met een bevolking die vier maal zo groot is al die van de VS: die Chinees heeft behoefte aan orde en rust en de CCP–dynastie levert die. Westerlingen kunnen niet begrijpen dat het China onder Xi goed kan zijn voor de wereldverhoudingen. Bovendien hebben de criticasters van China nogal wat boter op het hoofd. In de 19e eeuw werd China verkracht door de Fransen en Britten (onderbouwt door de schrijver met een krachtig artikel van de kunstpagina's van de New York Times) en in de Verenigde Staten kan men dan wel vrij kiezen, maar veel invloed op de politiek heeft dit niet en grote delen van de bevolking leven in armoede.

Het is een hypocrisie redenering die hij veel gebruikt: er mogen onvolkomenheden zijn, maar die zijn er aan de andere kant ook. Hij doet dat niet om de kritiek twee kanten op te richten, maar om ze te verstommen. Sterker nog hij gaat een stap verder. Het promoten van democratie kan wel eens gebeuren met de wetenschap in het achterhoofd, dat dergelijke bewegingen in staat zijn een land te ontwrichten (
de Arabische lente en kleuren opstanden in Oost-Europa hebben laten zien dat een dergelijk gevolg niet denkbeeldig is, dat is ook hier weer het genoemde argument voor de Chinese repressie zonder er iets dieper op de falende opstanden in te gaan). Voortbouwend op deze Machiavellistische redenering zou je eventueel, de schrijver is hier voorzichtig, kunnen stellen dat deze aanpak niet is gericht op democratie, maar op het verzwakken van de tegenstander.

Lichtend voorbeeld

Er is een heel hoofdstuk gewijd aan de Amerikaanse visie dat de Verengde Staten het lichtende voorbeeld voor de wereld zijn. Het is inderdaad een intrigerend gegeven hoe dit idee leeft en hoe geloofd wordt dat ze Gods eigen land zijn, het lichtende baken op de heuvel. Obama bracht de verheven gedachte weer terug op aarde en was er helder over dat het prijzen van de eigen natie er voor machtige Staten doorgaans bijhoort. Mahbubani geeft het extra aandacht door een 10-pagina lang artikel uit Foreign Policy als enige bijlage in het boek op te nemen, waarin deze waan of de Mythe van de Uitzonderlijke Verenigde Staten wordt weersproken.

Zelf gaat hij uitgebreid in op het verschuiven van de Amerikaanse democratie van
one men one vote systeem naar een structuur belangengroepen van de economische elite die het beleid grotendeels bepalen. Het grootste deel van de Amerikanen is bijvoorbeeld tegen het huidige vuurwapenbezit en voor een progressiever belastingsysteem, maar Congresleden die dit honoreren moeten zich er op voorbereiden dat hun concurrenten de volgende verkiezingen enorm meer fondsen krijgen en die zijn wezenlijk voor zetelwinst binnen het verkiezingsstelsel van de VS. Het land van de onbegrensde mogelijkheden biedt de armste delen van de bevolking bovendien nauwelijks kans om hoger op te komen. In China is de sociale mobiliteit aanzienlijk groter. Een slot argument dat hij gebruikt is dat het Amerikaanse sociale contract is gaan rusten op de pilaar van de individuele vrijheid en die van gelijkheid uit het oog is verloren. Zo verheven is het land bij nadere beschouwing niet.

Bondgenoten

Bij het beantwoorden van de vraag of China zal winnen, is het ook van belang om te weten hoe anderen zich in deze strijd zullen gaan opstellen.
“Beide partijen zullen verleid worden om de stevige geopolitieke spierballen te rollen, te vleien, om te kopen, armpje te drukken, alles om andere landen aan hun kant te krijgen.” De schrijver kijkt daarbij naar Australië, de Europese Unie, Japan, India, ASEAN en Rusland. De schrijver wist nog niet van het nucleaire AUKUS-pact van Australië, het Verenigd Koninkrijk en de Verenigde Staten. Hij kon nog schrijven over de moeilijke keuze die Australië moest maken. Het land is gelegen in de regio, verbonden met de Verenigde Staten, en de handel met China was in 2018 vier maal zo omvangrijk als die met de VS. Het gevaar op isolatie van de rest van de regio zou niet denkbeeldig zijn bij het varen van een Amerikaanse koers. Kishore Mahbubani hoopte op een Australische rol als onafhankelijke partij. Dat lijkt voorlopig van de baan. De VS hebben hier een voorsprong genomen.

Schrijvers die het hebben over de politiek van de Europese Unie missen vaak dat de EU een verband is van 27 Staten met verschillende belangen en verschillende buitenlandspolitieke oriëntaties. Zo zijn er die volmondig de Atlantische relaties onderschrijven, ook nu het Verenigd Koninkrijk vertrokken is. Anderen proberen een Europese politie vorm te geven. Mahbubani lijkt zich op die tweede groep te richten. China zou een goede partij zijn om samen mee op trekken om Afrika te ontwikkelen, nodig om op het continent levensvatbaar te houden voor de sterk groeiende bevolking, stelt hij. Of er veel handen voor op elkaar gaan in Europa. Dat valt te betwijfelen. De VS zullen proberen dit te voorkomen, zo stelt de auteur. Maar er wordt wel aan getrokken in Brussel, juist de door Covid gekrompen Chinese investeringsruimte biedt daarbij kansen. Dit nog los van de vorm die een dergelijke samenwerking zou krijgen en wie daarvan de vruchten zouden plukken.

Verklaring

De VS gebruiken China als afleidingsmanoeuvre voor een falend sociaal economisch beleid, zo merkt de schrijver op. Dat China een heel andere politieke structuur heeft en in de Verenigde Staten men toch al snel uitgaat van het heilige van de eigen Staat – het blijft terugkomen – maakt dit gemakkelijk verteerbaar voor de Amerikanen. Als ze redelijk zouden zijn dan hoeft er geen fundamentele tegenstelling te zijn. De schrijver haalt om dit te staven een aantal overeenkomsten (niettegenstellingen/noncontradictions) aan: beide hebben het doel de welvaart van de bevolking te verbeteren, zo stelt hij naïef door belangenstrijd te ontkennen.

De gemiddelde burger in de Verenigde Staten heeft zes maal zo veel inkomen als de gemiddelde Chinese burger, maar in de Verenigde Staten heeft twee derde van de bevolking geen $500 om noodzakelijke aankopen te doen. Stel je voor dat de vijf biljoen dollar (nu al bijna zes) dit sinds 9/11 tot aan publicatie werd uitgegeven aan onnodig buitenlands ingrijpen was verdeeld onder de Amerikanen, dat zou $29.000 per persoon zijn geweest. Zou het geld zijn besteed aan gezondheidszorg, onderwijs, schone energie en infrastructuur dan zouden miljoen extra banen zijn gecreëerd. Mahbubani ziet – aan de hand van Brown University – dat de wapenindustrie geen banenmotor is, maar banengroei in de weg zit. Het is verstandiger te zorgen voor het welzijn van de bevolking dan het uitgeven van miljarden voor oorlog, dat maakt een land door grotere samenhang ook sterker. Dit deel van zijn betoog staat als een huis.

Strijd en klimaatverandering

Dat de VS en China verschillende politieke waarden hebben wordt pas een probleem als ze die willen
exporteren. Belangrijk is te beseffen dat er verschillen van mening zijn en verschillende wegen die naar Rome en volwaardige leefomstandigheden leiden. In ieder geval zou het verschil in visie geen reden moeten zijn tegenstellingen te militariseren. Mahbubani heeft een optimistisch boek geschreven. Hij liet daarvoor ook zaken weg die niet in zijn straatje pasten.

Beide Staten hebben meer belang bij het samen de klimaatverandering afremmen dan het elkaar machtspolitieke vliegen afvangen. Nu gedraagt de meest intelligente soort zich als zelfmoordenaar, zijn woorden, en trekt niet samen op tegen deze bedreiging. Het is een van de punten waarop ik de auteur volmondig gelijk moet geven.

Het is bijna als of de confrontatiepolitiek tussen de VS en China een onbedoeld bijeffect is van een ongeïnformeerd politiek handelen. Als het zo was dan zou een pas op de plaats en een andere politiek koers volgen de dreigende clash vermijdbaar maken. Het lijkt er echter op dat kwesties alleen maar verder op de spits worden gedreven. Burgers in China, de Verenigde Staten en de rest van de wereld zijn daarmee niet geholpen, die willen sociale rechtvaardigheid, stabiliteit én vrijheid.

Grote verdwijntruc binnen Nederlandse wapenexportcontrole

Jaarlijks vergadert de Tweede Kamer over het Nederlands wapenexportbeleid. Erg veel prioriteit lijkt dat niet te hebben: het debat is voor de tweede keer voor onbepaalde tijd uitgesteld. Intussen gebeuren er vreemde dingen bij de Kamercontrole op grote exporten, ontdekte wapenonderzoeker Martin Broek.

Grote verdwijntruc binnen de Nederlandse wapenexportcontrole

In juli 2021 gaf de Nederlandse overheid een vergunning voor de export van militaire communicatie, commando en controle-apparatuur met bestemming Verenigde Arabische Emiraten. Ik verwerkte de informatie tot een tweet. Een oplettende lezer merkte op dat deze grote exportvergunning niet per openbare brief aan de Kamer gemeld was, terwijl dat bij wapenexport van meer dan € 2 miljoen wel moet, een gevolg van een in 2011 aangenomen motie, de zogenaamde motie El Fassed, naar het toenmalig GroenLinks Kamerlid die de motie opstelde. Bij de export naar de Emiraten gaat het om bijna het viervoudige, nl. € 7,8 miljoen.

Wordt alles aan de kamer gemeld?

Ik heb op een rijtje gezet welke vergunningen in 2020 werden verstrekt met een waarde groter dan € 2 miljoen, en wat blijkt? Er zijn leveringen van meer dan € 2 miljoen die wel gemeld worden, en anderen die passeren zonder een dergelijk brief. Waarom?

De website van de Tweede Kamer (commissies/buitenlandse-handel-en-ontwikkelingssamenwerking) stelt dat het Kabinet de Kamer informeert “in specifiek omschreven gevallen via de versnelde rapportage over afgegeven vergunningen. Hiervoor geldt een drempelwaarde van 2 miljoen euro. Elke vergunningverlening boven deze drempelwaarde moet versneld aan de Kamer gerapporteerd worden.” Deze leveringen hadden dus gemeld moeten worden, al is dit uitgangspunt niet helemaal helder geformuleerd. Immers betekent ‘in specifieke gevallen’ alles boven de drempelwaarde van € 2 miljoen, of is er meer?

Bij het invoeren van het beleid werd er van uitgegaan dat de Kamer zou worden geïnformeerd over eerste aanvragen voor definitieve uitvoer van complete wapensystemen met een drempelwaarde van €5 miljoen. Die drempelwaarde werd verlaagd naar 2 miljoen, dankzij de motie van Kamerlid El Fassed. Verder werd in de motie niet aangedrongen op aanpassingen.

Doorvoer niet gemeld – met alle gevolgen van dien

In totaal verstrekte de overheid in 2020 79 definitieve vergunningen met een omvang groter dan het drempelbedrag. In één geval gaat het om een vergunning voor doorvoer van Italiaanse reddingshelikopters voor Saoedi Arabië (waarde €82 miljoen). Aangezien het hier weliswaar om een vergunning gaat, maar niet om export, is deze niet opgenomen in dit onderzoek (het is bovendien geen levering aan een militaire gebruiker). Doorvoervergunningen en passage boven de drempelwaarde zouden in een optimale situatie meteen en openbaar gemeld moeten worden. In dit geval ging het om onschuldige goederen, maar dat niet altijd het geval. Waarom zou de Kamer daar niet meteen over geraadpleegd worden? Je kan het antwoord raden. De Regering regeert, en de Kamer controleert, zo is de formele uitleg, maar zo konden wel hele ladingen Tsjechische munitie aan de oorlogvoerende partijen van de coalitie tegen Jemen geleverd worden. Je kan er op zijn minst over debatteren of doorvoer met een dergelijke omvang al dan niet aan de Kamer gerapporteerd moet worden, en op welke manier.

Vergunningen wel of niet gemeld (zie tabel)

Van de 79 vergunningen betrof iets meer dan de helft (47) een nieuwe vergunning met een totale waarde van € 653 miljoen, de overige vervingen verlopende eerder verstrekt vergunningen. Die zijn niet in de tabel opgenomen.

Een Damen landingsvaartuig (gebouwd in de VAE) en geleverd met technologie aan Nigeria is weliswaar een herhaalde melding (16 mei 2019, NL0074CDIU0111504), maar ook oorspronkelijk ontving de Kamer geen brief, hoewel de drempelwaarde met € 6,6 miljoen ruimschoots overschreden werd. Dit was reden de vergunning wel op te nemen in de tabel. Wat ingewikkelder ligt het voor een levering aan Mexico. De Kamer werd geïnformeerd over een levering van € 3,7 miljoen, maar niet over de leveringen met een waarde van meer dan € 300 miljoen. Een zelfde methode zien we bij Maleisië. In 2017 werd de Kamer een levering gemeld ter waarde van € 4.525.000, blijkbaar geldt deze brief als informatie voor de levering van 2020 (hoewel een nieuwe levering en niet een herhaling van een eerder vergunning). Het beleid maakt al met al geen degelijke indruk.

Leveringen aan EU en NAVO+ landen is in de politieke constellatie van het moment niet controversieel. De bondgenoten kunnen buitensporig optreden maar ze blijven bondgenoten die verantwoordelijk zijn voor hun eigen beleid. De 36 vergunningen voor deze landen zijn eveneens niet in de tabel opgenomen. Alleen voor Turkije geldt een restrictiever beleid (al is dat recentelijk wel wat afgezwakt) en dat land blijft staan als leverancier van Pakistaanse marineschepen waar Nederland militaire technologie voor leverde.

De Kamer is in 2020 gerapporteerd over vier gevallen (de overheid meldt er 3, maar de Kamer werd in 2020 ook nog geinformeerd over een vergunning die in februari 2019 was verstrekt voor communicatiesystemen voor landingsschip voor de Qatarse marine. Deze brief is niet opgenomen in het overzichtje met het ‘Overzicht versnelde rapportages’ in het de rapportage Nederlandse wapenxportbeleid over 2020). Snel kan je de melding in dit geval niet noemen, maar de brief werd wel in dit kader door de Regering verstuurd. Wat niet versneld wordt gemeld wordt opgenomen in de maandrapporten, die verschijnen een paar maanden nadat de vergunning verstrekt is. Anders dan de versnelde melding aan de kamer heeft dit weinig tot geen invloed op het beleid, gedane zaken nemen immers zelden een keer.

Onderdelen niet door Kamer gecontroleerd

De levering van € 7,8 miljoen, het uitgangspunt voor dit blog, is een levering van “delen van.” Deze twee woorden zorgen voor de grote verdwijntruc binnen het systeem van directe rapportage aan de Tweede Kamer. Door dit uitzondering te laten zijn op de redenen de Tweede Kamer direct te informeren, blijven van de ruim 1.000 verstrekte vergunningen in 2020 er maar drie/vier over die gemeld moeten worden aan de Tweede Kamer. Dat lijkt op efficiëntie die het doel (de Kamer informeren en enigszins betrekken bij het wapenexportcontrolebeleid ) voorbij schiet. Zo hoeft de Kamer zelfs in het geval van terughoudend beleid – waar in het geval van de Emiraten sprake van is – geen melding te krijgen. Aangezien een zeer groot deel van de Nederlandse militaire export uit onderdelen bestaan valt zo ook veel buiten die controle.

Who are the clients for Dutch Information Security tech?

In January 2019 the Dutch government gave a license for information security technology to Myanmar. It was reported as part of the routine reporting of individual licenses and just one of many information security equipment as well ands software annual dual use exports (military or civil). Lets dive into the complicated issue of the massive volume of Dutch Information Security exports and Dutch praised openness on its exports.



The reported license is part of the Dutch transparency policy on strategic goods. Many of the Dutch strategic exports are on advanced technology and the Netherlands in 2019 was responsible for a quarter of all EU dual-use exports (p. 35 of Dutch annual arms export report). Often the specifics are hard to understand. This is not improved by the fact the reporting is extremely rudimentary. In the above mentioned case the name of exporting entity was not provided. Neither was the receiver on the other end in Myanmar. That is not an exception, but common policy. The date of license, a minimal description, end use, value and a EU dual use code is all what is given. That means not if the end user in Myanmar is an intelligence service, telephony provider, armed forces, foreign or domestic.

The EU code for dual-use (military and civil applications) exports, the so-called SG-Post, however classifies the specific technology and is not unimportant. In this Myanmar case it were 5A002a1 and 5D002c1 licenses. Category 5 deals with telecommunication and "information security”. Here both codes refer to equipment for encryption. But the licenses also include technology which can be used for defeating, weakening or bypassing "information security" and which was delivered to a number of countries. Under the Category 5 Dutch export licenses were exports in 18 different subcategories (see table).

Encryption equipment can be used to confidentially exchange information. It is part of the secrecy part of diplomacy, but also militarism. Philips USFA laid the foundation for this technology in the Netherlands and exported this kind of equipment to a wide range of destinations as was exposed in 1992 by peace activist aiming for conversion of this military activity by Philips USFA/Crypto. In 2003 these Phlips activities were partly sold to Compumatica Secure Networks in Uden en Fox-IT in Delft.

Dutch licenses for definitive dual use exports (there are also temporarily exports for trade shows, used by external parties etc.) were valued € 11 billion in the period Jan-Jul 2021. Of this Category 5 took 6 per cent, that is € 642 million, more than the total average of military exports in the same time span. The list of category 5 clients is wide ranging, it includes countries in the North and the Global South (see map, note that reporting for EU and NATO (+ Australia, Japan, New-Zealand, and Switzerland) is exceptional, covering a large part of the globe).

Information technology became mainstream news this year when the activities of Israeli company NSO were spotlighted. The company sold its knowledge and technology to regimes which used it to spy on opposition, human rights activists and journalists. The current levels of information technology makes it a dangerous weapon in the hands of despots, security services and the like. In the EU dual-use policy code 5A001j deals with surveillance systems or equipment, the interception of data. Control is essential and the EU policy on dual use states among more on cyber surveillance:

1. This authorisation does not authorise the export of items where ... the items in question are or may be intended, in their entirety or in part: ... for use in connection with a violation of human rights, democratic principles or the freedom of expression as defined by the Charter of Fundamental Rights of the European Union, by using interception technologies and digital data transfer devices for monitoring mobile phones and text messages and targeted surveillance of Internet use (e.g. via Monitoring Centres and Lawful Interception Gateways).

  The receiver of the technology makes a major difference. The EU names a few potential clients such as military, paramilitary, police, intelligence, surveillance end-use, other security end-use by the government, entities acting on behalf of the government. Mobile Phone provider or a secret services as end user can make world of difference (although both must be watched with care).

Licenses for exports of this technology are not always given by the Dutch authorities, pointing at the controversial character it has. The Netherlands denied three information security licenses. One had the United Arab Emirates as end receiver and two had Saudi Arabia. In case of these denials the receivers were provided, being respectively the UAE Ministry of Defence, the Saudi Royal Guard, and Air Force, but not the Dutch firm carelessly applying for such an export license. The other major Arab military power in the Middle East Egypt was denied several sales in the past few years: in 2018 to the Ministry of Internal Affairs by Alkan Telekom/Mantrac; in 2019 sales to the General Intelligence Service were refused two times.

The Netherlands has an industry on information security which is larger than the two companies previously mentioned. The Haque Security Delta shows a wide range of companies and government branches involved. This industry is of great importance, not only because of the financial size of its exports, but also of strategic importance by its nature and applications. The government is using and scrutinising its sales and cooperating at the same time. This conflict of interest may create the potential something slips through is always possible. Compumatica Secure now part of Tesorion) is a blank slate, but owners change and so are policies. (now part of NCC Group PLC) and also a party buying part of Philips USFA works for and with the Dutch State. The company is based in many countries, one of them the UAE. It has even a broader history in the Middle East delivered its knowledge and was proving workshops (see Buro Jansen en Janssens with a number of articles on n Fox-It, in Dutch and English and the search engine) to Syria, Egypt, Saudi Arabia and the UAE.

At least the naming of suppliers and type of recipients in a country is essential for proper control of government policy by Parliament and civil society organisations. Such control is even more important while the government is controlling companies it has a direct interest in and connection to. The system of Dutch reporting on the individual licenses was introduced in 2004-05. At the time the Netherlands was at the vanguard of public reporting on strategic goods in Europe, but after two decades of having a half transparent system it is time for a new wave of openness.
